🛡️ Legendary Grading Service (LGS) Terms and Conditions

Section 1: Agreement to Terms

These Terms and Conditions (“Terms”) govern the use of services offered by Legendary Grading Service LLC (“LGS,” “we,” “our,” or “us”). By submitting any items for authentication, grading, encapsulation, or related services (the “LGS Services”), you, the user (“you” or “Submitter”), agree to these Terms. If you do not agree, you must not use the LGS Services.

These Terms include our Privacy Policy, User Agreement, Submission Guidelines, Pricing Schedule, Archive Terms (if applicable), and any service-specific terms referenced herein. LGS may modify these Terms from time to time by posting updates on our website or via digital notice. Continued use constitutes acceptance.


Section 2: Services Overview

LGS provides:

  • Authentication, grading, and encapsulation of Trading Card Games (TCG), sports cards, tickets, memorabilia, and collectibles

  • Autograph authentication (where applicable)

  • Reholder, crossover, and review services

  • Secure digital certification and archival

  • Optional Archive storage services (see Section 20)


Section 3: Submission Eligibility

To submit items, you must:

  • Be at least 18 or have guardian consent

  • Create an LGS user account in good standing

  • Accurately complete the submission form

  • Own or be authorized to act on behalf of the item’s legal owner

Group submissions and dealer representatives must have prior written authorization or agreements with LGS.


Section 4: Submission Standards

Each order must:

  • Include items of one category (e.g., all sports cards or all TCG)

  • Follow our packaging and labeling guidelines

  • Be shipped individually per order; combining items from different services is not allowed

Submissions not meeting these requirements may be rejected, delayed, or incur correction fees. LGS may separate or return mixed submissions.


Section 5: Service Levels and Declared Value

Submitters must provide a “Declared Value”—a reasonable estimate of post-grading fair market value. This value:

  • Sets the maximum insurance liability

  • Determines the pricing tier

If LGS assesses that the fair market value exceeds the declared value, LGS may:

  • Adjust the service level and charge the fee difference

  • Suspend processing until payment is received

  • Return the item unprocessed if payment is declined


Section 6: Turnaround Times

Turnaround times are estimates based on submission volume and capacity. They are not guaranteed. Delays may occur due to high volume, holidays, natural disasters, or unforeseen events.

Do not contact LGS about turnaround status until the posted turnaround period has passed. LGS is not liable for any loss due to delays.


Section 7: Grading Process and Disclaimer

Grading is subjective and based on visual assessment by trained professionals. LGS does not guarantee:

  • Identical grades on resubmission

  • Agreement with third-party opinions

  • Investment or resale outcomes

Submitters acknowledge grading is an opinion, not a warranty of value or authenticity.


Section 8: Doctored, Counterfeit, and Fraudulent Items

LGS will not grade or authenticate items that are:

  • Counterfeit, trimmed, recolored, bleached, cleaned, or altered

  • Suspected of restoration or tampering

  • Submitted with intent to defraud

Such items may be rejected, deactivated, returned unprocessed, confiscated, or reported to authorities. LGS reserves the right to retain items submitted under suspicious or fraudulent circumstances.

You agree not to submit any doctored items and understand the submission fee is non-refundable even if an item is rejected.


Section 9: Grading Reviews and Reholders

Submitters may request a review (regrade) or reholder service. Results may change depending on condition or updated evaluation. LGS is not obligated to match previous grades. Reholders are only offered for intact, untampered LGS holders.


Section 10: Archive Storage (Optional)

If offered, Archive services allow submitters to store graded items at LGS’s Secured Archive Facility. Archive services are governed by the Archive Terms of Service. Items must be accepted into the Archive and meet eligibility criteria. Stored items remain the submitter’s property unless otherwise transferred.


Section 11: Labeling Errors and Certification Corrections

Submitters must inspect their orders and report discrepancies within 5 calendar days of delivery. Claims must be accompanied by proof. Errors not reported within this window are waived.

Items with verified labeling or certification errors must be returned for correction. Submitters agree not to sell or display such items publicly. Submitters who knowingly distribute mislabeled items may face penalties, including account suspension.


Section 12: Certification Database and Grader Notes

All certification numbers, grades, label content, images, and grader notes generated by LGS:

  • Are proprietary to LGS

  • May be published in our database for public verification

  • May be used in marketing or research

Grader Notes (if provided) are non-exhaustive and represent observations that influenced grading. They are not a guarantee of comprehensive disclosure.

Submitters grant LGS an irrevocable right to use and reproduce certification-related content.


Section 13: Risk of Loss and Insurance

LGS assumes responsibility only for items during confirmed possession (“Order Received” status). Prior to that, all risk remains with the submitter.

Items damaged, lost, or stolen while in LGS custody will be evaluated. Compensation is limited to the lesser of:

  • Declared Value, or

  • LGS-determined fair market value

Submitters waive all other claims, including for:

  • Sentimental value

  • Market fluctuations

  • Consequential damages

All claims must be submitted within 30 calendar days of delivery.


Section 14: Payment and Authorization

You authorize LGS to:

  • Charge your card for fees and service upgrades

  • Collect unpaid fees before releasing items

  • Hold or sell items to recover delinquent balances (after 180 days)

Fees include:

  • Grading and service fees

  • Return shipping and optional insurance

  • Upcharges for higher service levels due to value reassessment


Section 15: Refunds and Cancellations

Requests for cancellation are honored only before grading begins. If grading has started, fees are non-refundable.

Rejected items due to ineligibility or forgery are still charged full fees. Items marked as “Inconclusive” for autograph verification may receive partial refunds at LGS’s discretion.


Section 16: Deactivation of Certification

LGS reserves the right to deactivate any certification number for items that:

  • Are later found to be altered or counterfeit

  • Are removed from holders

  • Were submitted under fraudulent pretenses

Once deactivated, the certification number becomes invalid. The item cannot be resubmitted using the original cert ID.


Section 17: Arbitration and Dispute Resolution

By using the LGS Services, you agree to resolve all disputes exclusively through binding arbitration conducted under the Commercial Arbitration Rules of the American Arbitration Association (AAA).

You waive the right to:

  • Trial by jury

  • Participation in class actions

Arbitration will take place in the state of California. Each party is responsible for its legal fees unless awarded otherwise. You agree that the only remedy for dissatisfaction with the LGS Services is discontinuation of use.


Section 18: Indemnification

You agree to defend, indemnify, and hold harmless LGS, its affiliates, and employees from any claims, liabilities, or expenses arising from:

  • Violation of these Terms

  • Submission of altered, stolen, or counterfeit items

  • Misuse or misrepresentation of LGS certifications


Section 19: Force Majeure

LGS shall not be liable for any delay or failure in performance caused by:

  • Natural disasters

  • Acts of war, terrorism, or civil disorder

  • Government restrictions or labor disputes

  • Internet or communications failures

Section 21: Miscellaneous

  • These Terms constitute the full agreement between you and LGS

  • If any provision is deemed unenforceable, the remainder remains valid

  • Headings are for convenience and not legally binding

  • LGS may assign rights without restriction; you may not assign without consent
